Crawford vs. City of Houston


I’m proud to share a recent victory for the family of Senior Police Officer Gary Crawford, who was denied workers' compensation death benefits after his tragic passing. A Harris County jury ruled in favor of his widow, affirming that his fatal injury was work-related—an outcome that reinforces the rights of injured workers and their families.

 

Case Summary:
Senior Police Officer Gary Crawford of the HPD was injured in the course and scope of his employment on February 6, 2019. He slipped and fell on a pool deck at a Texas City facility while training for Swift Water Rescue. He struck the back of his head on the concrete deck, saw stars, and temporarily lost motor control of his arms. He was diagnosed the next day in the E.R. with post-concussion syndrome.

 

Crawford passed away on March 25, 2019, due to an intracerebral aneurysm in the occipital area of the brain. The City of Houston accepted a concussion only, and when his widow, Jodie Crawford, applied for death benefits, the City denied the application, claiming there was no medical evidence linking his death to the fall.

 

On February 5, 2025, a Harris County jury returned a 10-2 verdict in Mrs. Crawford’s favor, finding that the fall was a producing cause of death. Mrs. Crawford, a retired HPD officer, will now receive workers' compensation death benefits for her lifetime, along with reimbursement for funeral expenses.

 

Caldwell Fletcher, PC is proud to have represented the Crawford family. Our firm represents injured workers at the administrative agency (TDI DWC) and in District Court. The Crawford decision will advance the rights of similarly situated employees (or survivors of employees) who face adverse determinations at the administrative level. These claims decisions are simply unilateral decisions that may be reviewed by the administrative agency and, ultimately, the courts. The Crawford outcome demonstrates that these decisions are not final—they can and should be reviewed by a higher authority than an insurance adjuster.
